Milan, 13 July 2026 – With reference to the press release issued today by TIM, INWIT deems it appropriate to clarify that it is incorrect to state that the Court “confirmed the rightfulness of the termination of the MSA”.
The ruling, indeed, has been indeed issued within an interim proceedings phase, and the judge merely noted that, at present, the requirement of urgency (the so-called periculum in mora) has not been met. As expressly recognized by the judge themselves, the core issues of the dispute – and specifically the validity of the exercise of the option by INWIT in 2022 and of the subsequent termination by TIM – require an assessment that can only be carried out during an ordinary judgement on the merits of the case.
The pivotal issue concerning the interpretation of the contract and the lawful exercise of the termination remains unaffected and has been expressly deferred to the ordinary trial.
