Milan Court confirms dismissal of the request of an interim injuction regarding Fastweb MSA termination notice solely on grounds of periculum in mora

19 October 2026

Rome, 19 October 2026 – INWIT announces that today the Court of Milan (Specialised Enterprise Section) confirmed the dismissal of the request for an interim injunction filed by the Company to protect its interests in advance regarding the effects of the MSA termination notice exercised by Fastweb, finding unsubstantiated the requirement of periculum in mora (urgency).

According to the Court, the devaluation of INWIT’s shares, among other factors, already occurred “concurrently with the joint press release issued by TIM and Fastweb regarding the reaching of a non-binding agreement to establish a Joint Venture and build 6,000 new towers.”

With respect to the fumus boni iuris, the Court deemed it appropriate to “avoid preempting the judgment with a decision that, in a case of such complexity and significance, would inevitably serve as an ‘internal precedent’ for the Court when called upon to rule on the merits of the case (…)”, also for reasons of symmetry with the parallel (and in many respects similar, albeit distinct) dispute involving TIM S.p.A.

The Panel of judges therefore decided to refrain from examining the fumus boni iuris regarding the duration of the MSA, also in order to avoid a summary assessment in a complex and significant dispute to be decided with full knowledge of the facts in the pending ordinary trial, which INWIT remains confident will conclude that the termination notice recently received from Fastweb is invalid.
